Madras High Court Orders All Private Schools in Tamil Nadu to Display Fee Structure

In a significant ruling, the Madras High Court has mandated that all private unaided schools in Tamil Nadu display their approved fee structures prominently on school notice boards and official websites. The court's decision stems from a petition filed by the All India Private Educational Institutions Association, which challenged a circular issued by the Director of Private Schools on June 1, 2026. The circular instructed all private schools to publish their approved fee structures by June 5, 2026. The association contended that private schools are not 'public authorities' under the Right to Information (RTI) Act and, therefore, not obligated to disclose such information.

Justice M. Dhandapani, while acknowledging that private schools are not public authorities under the RTI Act, emphasized that they are still bound by the Tamil Nadu Private Schools (Regulation) Rules. These rules mandate that schools display details of their infrastructure, staff strength, student strength, seats available in each standard, approved fee structure, and other facilities on notice boards and websites. The court observed that the schools cannot evade this statutory obligation and must comply with the regulations in letter and spirit.

The ruling is expected to benefit parents by providing clear and upfront information about the fee structures of private schools, thereby reducing instances of unexpected and arbitrary fee demands. It also underscores the importance of regulatory oversight in the education sector to ensure fairness and transparency.

The All India Private Educational Institutions Association has expressed concerns over the court's decision and is contemplating further legal options. However, for now, the directive stands, and private schools across Tamil Nadu are required to adhere to the court's order.
